George taxi licence hearing update

A Provincial Regulatory Entity (PRE) hearing in Oudtshoorn to consider the possible suspension or cancellation of operating licences held by 32 members of the Uncedo George Taxi Association has been postponed. Because two of the witnesses who were due to testify in the matter opted not to do so, the matter was postponed by agreement to 15 June 2016. 

The hearing was convened in terms of section 79(2)(b) of the National Land Transport Act after members of the association or their employees were allegedly implicated in violent protest action in George on 19 August 2015. Operating licences can be suspended or revoked if holders fail to adhere to their licence conditions. 

The legal teams for the complainants and the defendants have advised that no further witnesses will be called.  The PRE will have the recordings of the inquiry transcribed and sent to the legal teams no later than 23 May 2016.  The complainants will file written heads of arguments by 6 June 2016, and the defendants will have until 13 June to file responses. One day (15 June 2016) has been set aside for oral arguments to be presented to the PRE at the Oudtshoorn Municipality’s offices.

The PRE will discuss the matter in a committee meeting and communicate the outcome to the parties within seven days. Under section 92 of the Act, parties have the right to lodge an appeal with the Transport Appeals Tribunal.
