Minister Kaizer-Philander welcomes recognition of child protection services as essential services

Western Cape Minister of Social Development Wendy Kaizer Philander has welcomed the decision by the Commission for Conciliation, Mediation and Arbitration’s Essential Services Committee (ESC) to designate critical child protection services as essential, describing it as an important step towards strengthening the protection of vulnerable children.

Signed on 15 October 2026, the determination made in terms of section 71 of the Labour Relations Act recognises that interruptions to critical child protection services can expose children to abuse, neglect, exploitation and even loss of life.

The Western Cape Department of Social Development was among the parties that supported the designation during the ESC investigation.

Minister Kaizer Philander said the decision reinforces the responsibility to ensure that vulnerable children receive protection when they need it most.

“Children depend on responsible adults, communities and dedicated professionals to protect them from harm. When a child faces abuse, neglect or violence, help cannot wait. This decision recognises the vital work being done every day to keep children safe. During Social Development Month, this decision is a reminder that protecting our most vulnerable children requires practical action and a shared commitment to ensuring their safety, care and wellbeing.”

The designation includes statutory child protection investigations, emergency interventions, the removal of children from unsafe environments, alternative care placements, Children’s Court investigations, foster care supervision, family reunification and psychosocial support for children affected by abuse and trauma.

The Minister also acknowledged the dedication of social workers and designated child protection organisations, who often intervene in difficult and dangerous circumstances to ensure vulnerable children receive the care and protection they deserve.

“The work of our social workers and child protection partners can mean the difference between a child remaining in danger and finding safety. Their commitment plays a vital role in protecting children and safeguarding their wellbeing.”

The ESC has directed the relevant parties to negotiate and conclude a minimum service agreement within 90 days of the designation. The Department acknowledges this requirement and recognises the importance of maintaining critical child protection services while respecting employees’ rights.

Minister Kaizer Philander reaffirmed the Department’s commitment to strengthening the child protection system and supporting those who serve vulnerable children across the Western Cape.

“Every child deserves to feel safe, to be heard and to grow up knowing that someone cares about their wellbeing. We must continue working together to build communities where children are protected and their best interests always come first.”
